Recent Developments: Cost of Claims

A study conducted by AON in October 2005 for example, on Hospital Profession Liability and Physician Liability, found for the first time in years an overall decrease in medical liability claims for both doctors and hospitals. The study goes on to explain how the four states of Texas, Pennsylvania, Florida, and California, who are in the forefront of the decline in frequency of claims, have each passed some sort of legislative reform- like the capping of non-economic damage/liability awards for instance- that makes it increasingly unattractive for the plaintiff's attorneys to press for medical malpractice liability insurance claims.
Proposals to Make Medical Malpractice Liability Insurance More Affordable
  • Expand the number of states in the US that have pre-trial screening panels.

  • Place considerable emphasis on risk management. Identifying the main cause of most medical malpractice claims and setting up high standards to counter and avoid them would see a significant reduction in the number of such claims along with a corresponding reduction in medical malpractice insurance costs.

  • Take firm action against those doctors who have the most number of multiple judgments given against them, and who send insurance costs spiraling for all.

  • Form what is called a Risk Retention Group (RRG). RRGs are what are commonly called the alternative market that provides cover in the health and medical care field.

  • Create specialized law courts to handle medical malpractice claims and insurance liabilities.

The Government seems to be doing its best to reduce the cost of medical malpractice insurance cover, even as the f-number of medical malpractice insurance companies seems to be on the wane. But the people also have a responsibility in ensuring that that the medical malpractice liability insurance claims that they bring to the courts of the land are justified.
